By accessing or using any service provided by 5P COMPANY, 5P Technology, or 5P CONNECT, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our services.

2. 5P CONNECT – Bridging Services Disclaimer

5P CONNECT as an Intermediary Only

5P CONNECT acts solely as a bridge or intermediary to connect individuals with third-party organizations offering jobs, scholarships, internships, business mentorship programs, and local or international tours. 5P CONNECT does not provide these services directly.

Important Disclaimers:

  • Once an application is submitted to or approved by a third-party organization, the relationship is strictly between the applicant and that organization.
  • 5P COMPANY, 5P CONNECT, and 5P Technology are not involved in any subsequent agreements, decisions, approvals, rejections, or outcomes.
  • When a user's application is granted by a specific company or organization, the user is no longer considered a client of 5P COMPANY for that specific service, even if their data remains stored in our system.
  • We shall not be held liable for any loss, damage, dispute, or issue arising from interactions with third-party organizations.

User Responsibility: Users are strongly advised to exercise due diligence and caution when dealing with any third-party organization. We recommend verifying the legitimacy of any organization before sharing sensitive information or making any payments.

3. 5P Technology – ICT Services Disclaimer

5P Technology – Third-Party Infrastructure Reliance

5P Technology delivers enterprise ICT services including:

  • Website hosting and domain registration
  • CCTV installation and security systems
  • Enterprise networking
  • Database administration
  • IoT device installation
  • Hardware maintenance
  • ICT technical support
  • Software installation

Third-Party Infrastructure Disclaimer: Our services rely on third-party infrastructure such as domain registrars, VPS providers, hosting providers, database service providers, and telecommunication networks. 5P Technology is not responsible for:

  • Database linkage failures, data corruption, or data loss beyond our direct control
  • Hosting server downtime, outages, or performance issues caused by third-party hosting providers
  • Domain name closure, suspension, revocation, or blacklisting due to reports of fraud, spam, or malicious activity reported by internet users, authorities, or domain registrars
  • Any service interruption, data breach, or security incident caused by third-party infrastructure failures
  • Out-of-service periods due to circumstances beyond our reasonable control (force majeure)

Any issues arising from third-party services are governed by the terms and conditions of those respective service providers. 5P Technology will assist in resolution to the best of our ability but assumes no liability for third-party failures.

4. Advertising & Media Usage Rights

Media Usage for Promotion

By using our services, uploading content, participating in our programs, or submitting any media (including images, videos, testimonials, reviews, or other client details), you grant 5P COMPANY, 5P Technology, and 5P CONNECT an irrevocable, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, and display such media for advertising, marketing, promotional, and educational purposes across all our platforms, channels, and marketing materials.

You expressly acknowledge and agree that:

  • No compensation, payment, or royalty will be paid to you or any third party for any such use
  • You will not take any legal action, make any claim, or seek any remedy regarding the use of your media in advertising or promotion
  • This license survives the termination of any service agreement or relationship
  • We may edit, modify, crop, or combine your media with other content without your prior approval
  • We may use your name, likeness, and biographical information in connection with such media

If you do not wish for your media to be used for advertising purposes, you must notify us in writing before using our services or submitting any media. However, such notification may affect our ability to provide certain services.

5. Service Limitations & Availability

While we strive to provide reliable and uninterrupted services, we do not guarantee that our services will be uninterrupted, error-free, or completely secure. 5P COMPANY, 5P Technology, and 5P CONNECT are not liable for:

  • Any service interruptions, delays, or failures caused by circumstances beyond our reasonable control
  • Loss of data, revenue, or goodwill resulting from service interruptions
  • Actions or inactions of third-party service providers, partners, or organizations
  • Any damages resulting from the use of or inability to use our services

6. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, 5P COMPANY, 5P Technology, 5P CONNECT, and their respective officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for any claim arising out of or relating to these terms or our services shall not exceed the amount you paid to us, if any, in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless 5P COMPANY, 5P Technology, 5P CONNECT, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or relating to your use of our services or violation of these Terms.

Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any dispute arising out of or relating to these terms or our services shall be resolved exclusively through binding arbitration in Dar es Salaam, Tanzania.
